Chinese Philosophy on Medical Privacy

-Family would have majority of control, as opposed to following the wishes of the patient

-Patient was forced to rely on judgement of family

-Doctor and family determined the goals of treatment instead of the patient

-The patient was rarely aware of any of the facts or future events of their condition

-Doctor would mislead the patient at the request of the family

-Patient privacy is not a issue that is taken into consideration by the doctor





Western Philosophy of Medical Privacy

-Family only gets priority of opinion when patient's own wishes are unattainable

-Patients have significantly more influence in making the decisions regarding their health that they themselves want to

-Regardless of patient decision, doctor cannot threaten to release information to attempt to force patient to go with a certain kind of treatment.
-Patient, more than anyone, knows specific details of ailment

-Unlike Chinese philosophy, patient is informed about their status every step of the way








What is privacy???

Definitions-

New: The state of being free from intrusion or disturbance in one's private life or affairs, including information, space, and physical property.

Old: The right to be left alone / Protection against intrusion upon seclusion



Why is privacy important???

-Safety of patient information
:If confidential patient information were to be disclosed to the wrong people, patient very well might feel harassed, safety could become an issue, or they might even feel like filing a lawsuit. Could become a negative advertisement issue for the hospital or program.

-Ensures patient's honestly to enable better treatment
:If patient isn't willing to disclose entire truth, mistreatment or even harm could come to the patient. This could have detrimental effects on the doctors career if it becomes known that they had a situation of malpractice.

-Protects doctor from frivolous lawsuits
:A lawsuit could not only impact the doctor, but also spread into their co-workers or the hospital they work for. Could put the doctor's entire practice in jeopardy. Could then affect doctor's family and personal life, non-necessarily involving others. The doctor accused could very well be a good practitioner, but because of one incident, other patients might not be able to get the care he provides.









Reasons for patient confidentiality

-Ensures patient honesty in disclosing necessary information

-Inspire's patients trust in doctor

-Creates respect for patient, making them feel safer

-Allows patient to feel at ease in the medical environment



Restrictions on patient confidentiality

-When a court order is present

-When a disease becomes apparent, and specific information needs to be disclosed, but some things, like names of those infected, doesn't need to be disclosed

-Patient studies


When this confidentiality is waved

-When personnel present danger to self or others including both patients and colleagues

-Legal duty to report to report malpractice or unsafe personnel

-Educational purposes including medical students or advanced training
